HC concludes lawsuit by Pakistani company to restrain Centre from allowing rice exports under the label ‘Super Basmati’

The Delhi High Court has dismissed a lawsuit filed by Pakistani entities seeking an injunction against the Indian government to prevent rice exports under the trade name ‘Super Basmati’. The suit was dismissed due to non-prosecution, as nobody appeared on behalf of the plaintiffs since 2020.

The plaintiffs, including the Trading Corporation of Pakistan Private Limited, Rice Exporters Association of Pakistan, and Basmati Growers Association, had requested a permanent injunction against the Indian government from implementing a Gazette Notification from May 24, 2006. This notification allowed exports of Basmati rice or any rice from India under the name ‘Super Basmati’.

The Trading Corporation of Pakistan Private Limited, whose shares are owned by the Ministry of Commerce of the Government of Pakistan, had filed the plea.

In response, the government of India’s counsel cited a September 18, 2017 notification issued by the Ministry of Agriculture. According to this notification, the seed production of all Basmati rice varieties is restricted to specific geographical indication (GI) registered rice growing areas in Delhi, Punjab, Haryana, parts of Uttar Pradesh, and Jammu and Kashmir.

In conclusion, the Delhi High Court has closed the proceedings in this lawsuit since the plaintiffs failed to prosecute the case. The dismissal allows the Indian government to continue permitting rice exports under the trade name ‘Super Basmati’.
